1. Agreement to Terms

By accessing or using the Chert network, wallet, explorer, or any related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and Chert ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes indicates your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that:

  • You are at least 18 years old
  • You have the legal capacity to enter into these Terms
  • You are not located in, or a citizen or resident of, any jurisdiction where the use of the Services would be illegal or otherwise prohibited
  • You will comply with all applicable laws and regulations in your jurisdiction
  • You are not subject to economic sanctions or trade restrictions

3. Nature of Services

Chert is a decentralized blockchain network. Our Services provide tools and interfaces to interact with this network, including:

  • Wallet Services: Non-custodial wallet software for managing CHERT tokens
  • Network Access: APIs and tools to interact with the Chert blockchain
  • Explorer: Block explorer for viewing network activity
  • Staking: Interfaces for participating in network consensus

Important: We do not have custody of your private keys, tokens, or any digital assets. You are solely responsible for the security of your wallet and private keys.

4. User Responsibilities

You agree to:

  • Maintain the security and confidentiality of your private keys and wallet credentials
  • Accept full responsibility for all activities that occur under your wallet address
  • Not use the Services for any unlawful purpose or in violation of any applicable laws
  • Not attempt to interfere with, compromise, or disrupt the Services or network
  • Not use the Services to conduct any fraudulent, deceptive, or manipulative activities
  • Not attempt to reverse engineer, decompile, or disassemble any aspect of the Services

5. Risks and Disclaimers

Using blockchain technology and digital assets involves significant risks, including but not limited to:

  • Volatility Risk: Digital asset prices can be highly volatile
  • Technology Risk: Software may contain bugs or vulnerabilities
  • Regulatory Risk: Laws and regulations may change
  • Loss Risk: Loss of private keys results in permanent loss of assets
  • Network Risk: Network congestion, forks, or failures may occur

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHERT COIN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services
  • Any unauthorized access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, or the like that may be transmitted through the Services
  • Any loss or damage of any kind incurred as a result of your use of any content posted, transmitted, or otherwise made available via the Services

7. Intellectual Property

The Chert protocol software is open-source and available under the applicable open-source licenses. However, the Chert name, logo, and branding are proprietary and may not be used without our express written permission.

You retain ownership of any content you create or submit through the Services, but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Services.

8. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

Due to the decentralized nature of the blockchain, termination of access to our Services does not affect your ability to interact with the Chert blockchain through other means.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chert operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
